General Terms and Conditions of IMPIRE AG for Consumer Agreements

§ 1 Scope and Supplier

These General Terms and Conditions apply to all orders placed by consumers (Sect. 13 of the German Civil Code) in the online shop of

IMPIRE AG, Münchener Str. 101b, 85737 Ismaning
Executive Directors: Hartmut Braun, Harald Keilbach, Christian Holzer
("IMPIRE“).

§ 2 Formation of Agreement

(1)     The product descriptions in the online shop are designed to invite purchase offers. By clicking the “Order” button you are making a binding purchase offer. The sale of our products is made solely for private use and in standard household quantities.

(2)    We can accept your order by sending a separate order confirmation via email or by shipping the merchandise within five days. The confirmation of receipt of the order is made by automated email immediately after placing the order and does not constitute acceptance of the offer.


§ 3 Delivery

(1)    If not all products ordered are in stock we may make partial deliveries at our cost to the extent this is reasonable.

 (2)    We may rescind the agreement if delivery of the merchandise fails through your fault despite three delivery attempts. Payments already made, if any, will be refunded to you immediately.  

(3)    If the product ordered is not available because we are not supplied with the product by our suppliers through no fault of our own, we may rescind the agreement. In this case, we will inform you immedi-ately and may suggest delivery of a comparable product. If a comparable product is not available or if you do not wish delivery of a comparable product, we will immediately refund payments made by you, if any.

§ 4 Prices, Terms of Payment

(1)     All prices are gross amounts including the respective applicable legal VAT but excluding shipping fees. Cash discounts are not granted.

(2)    Payment may be made via PayPal or credit card at your choice. In case of credit card payment, your account is charged upon placement of the order, respectively.

(3)    If you are in payment arrears, interest in the amount of 5% above the applicable base rate is pay-able on the purchase price. We reserve the right to demonstrate and assert higher default damage.  

(4)    You are only entitled to set off if your counter-claims have been finally determined by a court of law or if they are undisputed or recognized by us in writing.

(4)    You may only exercise a retention right if and to the extent that the claims are based on the same contractual relationship.

§ 5 Retention of Title

The merchandise remains our property until complete payment. Prior to transfer of ownership, any en-cumbrance, security transfer, processing or modification is not permitted without our consent.

§ 6 Right of Withdrawal

(1)     You are entitled to a fourteen day withdrawal right (see Withdrawal Policy).

(2)     Please avoid damages and contamination. Please return the merchandise to us in the original packaging with all accessories and all packaging materials, if possible. If required, please use pro-tective secondary packaging. If you do not have the original packaging anymore, please ensure suf-ficient protection against transport damages by using appropriate packaging; thus, you ensure that you avoid damage claims because of damages based on insufficient packaging. Please return the merchandise to us as a prepaid parcel and keep the receipt. Upon request, we will happily reim-burse you for the shipping charges in advance, as well, unless you have to bear them yourself. This information does not constitute any mandatory requirement for the exercise of the withdrawal right.

 (3)    If you are exercising your withdrawal right, you must bear the standard return charges if the mer-chandise delivered conforms to the merchandise ordered and if the price of the item to be returned does not exceed EUR 40 or, in case of a higher price of the item, if you have not yet made full pay-ment or a contractually agreed installment payment at the time of the withdrawal. Otherwise, you may return the item free of charge.

§ 7 Warranties

The warranties are subject to the statutory provisions.


§ 8 Notice according to the German Battery Act (Batteriegesetz)

As our shipments may contain batteries and rechargeable batteries, we are obligated under the German Battery Act to notify you of the following: Batteries and rechargeable batteries must not be disposed of as household waste; rather, you are legally required to return used batteries and rechargeable batteries. Old batteries may contain pollutants which may damage the environment or your health in case of improper storage or disposal. Batteries also contain important raw materials, however, such as e.g. iron, zinc, man-ganese or nickel, and can be recycled. You may return the batteries to us after use or you may return them free of charge locally in your immediate vicinity (e.g. in stores or communal recycling centers or in our dispatch warehouse). Return in stores is restricted to the usual end user quantities and to those old batteries which the operator has or used to have in its range.


§ 9 Rebate Codes

All rebate codes apply only to the order of sets and cannot be used for single products.

§ 10 Storage of the Text of the Agreement

We store the text of the agreement and will send you the order details and our GTC via email. You may access the GTC here <Link to GTC> at any time. For security reasons, your order data cannot be ac-cessed via the internet anymore.

§ 11 Support and Newsletter

(1)     If IMPIRE provides a support hotline, you will be informed about the costs of the call which exceed the standard local charge.

 (2)    Upon registration for the newsletter, your email address will be used for your promotional purposes until you unsubscribe the newsletter. Un-subscription is possible at any time.

§ 12 Miscellaneous

(1)     Should a provision of these General Terms and Conditions be invalid, the remaining agreement is unaffected. Instead of the invalid provision, the pertinent statutory provisions shall apply.      

(2)    Solely the laws of the Federal Republic of Germany, excluding the United Nations Convention on Contracts for the International Sales of Goods (UN sales law/CISG), apply.
